PREAMBLE

The General Terms and Conditions of Sale below apply to the sale of guided tour services by VIALITY TOUR.
VIALITY TOUR, a simplified joint stock company, whose head office is located at n°1 rue de Stockholm 75008 Paris, is registered under the SIRET number 901 771 881 00017.
The present general conditions are applicable to any purchase, use or reimbursement of services as well as to any use of the https://www.vialitytour.com website .

ARTICLE 1: Definitions

The internet platform provides a description of the services offered by VIALITY TOUR.
VIALITY TOUR reserves the right to add to the current offer or to cease the distribution of certain services at its sole discretion and at any time.
PARTIES
Refers to the customer and/or the company VIALITY TOUR
CUSTOMER
Refers to the purchaser of an activity, the customer may or may not be the beneficiary of the service depending on whether or not he/she will make personal use of it.
USER
Refers to the person connecting to the site, without necessarily being a client or a beneficiary.
SERVICE
Refers to the service provided by VIALITY TOUR to the beneficiary, it being understood that the conditions of execution of this service are dependent on availability on the date chosen by the beneficiary.
PERSONAL DATA
Refers to any information used on the Internet to identify a physical person (name, first name, e-mail address)
COOKIES
Refers to small files sent to the hard disk of the user's computer to facilitate navigation on the site and to allow access to the most appropriate pages when returning to the site
SITE
Refers to the site accessible under the URL https://www.vialitytour.com

ARTICLE 2: Scope of application

2.1 Acceptance of the general terms and conditions of sale is essential prior to the acquisition, receipt or use of an activity on the site.
The user acknowledges the general terms and conditions of sale in their entirety by clicking on the hypertext link provided for this purpose, and accepts them by ticking the box provided.
Failure to accept the general terms and conditions of sale in the aforementioned manner shall deprive the user of the possibility of continuing with the booking process in progress.
If the user does not agree to these general terms and conditions, he/she shall refrain from initiating the booking process.
2.2 These general terms and conditions of sale are applicable only to reservations of activities made on the site.

2.3 VIALITY TOUR reserves the right to modify these general terms and conditions of sale at any time, without prior notice. In this case, the general sales conditions in force on the day of the order will be applied.
2.4 All Customers declare that they have the legal capacity in accordance with article 1124 of the Civil Code to contract and use the Website in accordance with the Website's General Terms of Sale and Marketing.

ARTICLE 3: Formation of the contract

3.1 Reservations can only be made by the user on the website https://www.vialitytour.com.
3.2 The user selects the proposed activity from the online catalog.

3.3 The user selects the number of participants according to their age.
3.4 A summary is then sent to the user, showing the choices made as well as the price of the total amount of the reservation, with an indication of the method of payment for which the user opts.
3.5 In application of the provisions of article 1369-5 of the Civil Code, this first click allows the user to check the details of his/her reservation, the total price of the reservation, and to rectify any errors before the final reservation is recorded.
3.6 The reservation is only recorded and the contract is only deemed to be definitively concluded once the client's bank has accepted the payment.
3.7 In application of the provisions of article 1369-5 paragraph 2 of the civil code, a confirmation email will be sent to the user, acknowledging receipt of the reservation sent to VIALITY TOUR.
3.8 The conservation and/or printing of the confirmation email will enable the client to provide proof that the reservation was made with VIALITY TOUR.

ARTICLE 4: Terms of payment

4.1 The VIALITY TOUR website uses the Stripe secure payment system. It will allow the customer to book the service immediately and firmly.

4.2 Payment can only be made by credit card, Visa card, Maestro card, Mastercard, American Express card or by PayPal.

4.3 Payment will result in the immediate debiting of the full amount of the reservation on the day the reservation is made.
4.4 In the event of non-payment or refusal of authorisation by the client's bank, VIALITY TOUR is entitled to suspend the booking process.
4.5 If the customer has a PayPal account, if the customer chooses to pay by credit card, the customer will have the option of paying via their PayPal account.
If the customer does not have a PayPal account, he/she will be asked to create one by following the instructions that will be sent to him/her.

ARTICLE 5: Fees

5.1 The prices of the visits appearing on the Site are expressed in euros and include all taxes.

5.2 VIALITY TOUR reserves the right to modify the rates at any time and without justification. The services will be invoiced on the basis of the rates in force on the day the firm and definitive reservation is made.

5.2 VIALITY TOUR reserves the right to apply discounts and promotional offers at its own discretion. The offer will be clearly displayed on the Site and automatically taken into account at the time of payment of the reservation by the client.

5.3 As soon as the reservation is validated and paid, VIALITY TOUR cannot apply retroactively the discounts and promotional offers.

 

ARTICLE 6: Validity of the offer

6.1 In the event of the purchase of a service that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail or telephone. The client may then demand a full refund or postpone the activity to an available date.

6.2 VIALITY TOUR reserves the right to cancel any tour that does not reach the minimum number of 2 participants in total. In this case, the booking fee paid for the cancelled tour will be refunded.

Article 7. Conditions of use of promo codes

  1. 1 The promo code is valid until the expiry date stated on the email accompanying the user's receipt of the promo code.
    7.2 A promotional code is non-refundable. It may not be contested by users in any way, nor may it be exchanged for cash, nor replaced or exchanged for any reason whatsoever.
    7.3 The customer is informed that if the amount of the chosen activity is higher than the amount covered by the promotional code, he/she can complete the price difference by paying the difference directly on the site. Similarly, if the amount is lower, the promotional code will remain valid and can be used again to pay an amount corresponding to the price difference until the expiry date.

7.4 A promotional code can be used within the limits of available places.

 

ARTICLE 8 : Responsibility of VIALITY TOUR

8.1 VIALITY TOUR undertakes to make every effort to ensure the validity and clarity of the information made available to the user.
8.2 VIALITY undertakes to offer tours in accordance with the description given on the "Reservation" page of the website.

ARTICLE 9: Customer's responsibility

9.1 The customer undertakes not to disrupt the smooth running of the visit.

9.2.1 The customer undertakes to comply with the instructions given by the guide regarding the use of the virtual reality headset throughout the visit.

9.2.2 VIALITY TOUR may claim compensation from the client for any damage caused to the virtual reality helmet by the client during the visit, resulting from failure to follow the instructions for use given by the guide.

9.3 Any error in the activities ordered must be reported by the client by letter or email (contact@vialitytour.com) within 48 hours of the date of receipt of the booking.

 

ARTICLE 10: Conditions for participation in the visit

10.1 The general terms and conditions of sale must be brought to the attention of the beneficiary of the activity. This information shall be provided by the client, if necessary.
10.2 The possibility of benefiting from a service is subject to the prior presentation of the confirmation e-mail.

10.3 The tours offered on the Site are not accessible to children under the age of 8. The client agrees to respect this rule. VIALITY TOUR reserves the right to refuse any participant who does not respect the age limit.
10.4 As certain conditions must be taken into consideration (extreme weather conditions, physical condition of the participants and physical condition of the guide), VIALITY TOUR may validly refuse to carry out the service, or postpone it, if the required conditions are not met.

ARTICLE 11: Security and Insurance

11.1 The client is responsible for all damage caused by him/her during the performance.

11.2 The Client is fully responsible for any incident that occurs during the activity (offence, accident, theft or loss of valuables, direct or indirect damage that the Client or participant may cause to other participants) and confirms that he/she has taken out third party insurance.

11.3 For its part, VIALITY TOUR has taken out professional liability insurance.

ARTICLE 12: Other rights of the provider

12.1 VIALITY TOUR can cancel the activity on the planned date without having to observe a cancellation period if weather conditions, administrative measures, strikes or other external circumstances that cannot be foreseen or can only be avoided with disproportionate efforts on the part of VIALITY TOUR and that are not within its sphere of influence, in particular events of force majeure, make it impossible to carry out the activity or make it considerably more difficult or endanger it. In this case, the reservation price paid for the cancelled activity will be refunded.

12.2 VIALITY TOUR can refuse access to a tour to any participant who does not meet the conditions of participation required in these terms of sale. In this case, the booking fee paid for the tour will not be refunded.

12.3 If a participant causes lasting disruption to the tour in any way, VIALITY reserves the right to exclude him/her from the tour. In this case, the booking fee paid for the tour will not be refunded.
12.4 VIALITY TOUR can make minor programme changes at any time if this seems necessary due to circumstances that have arisen at short notice. Minor programme changes also include a change in the meeting point for the tour if the customer can reach the new meeting point from the originally agreed meeting point on foot or by public transport within 15 minutes. A change of meeting point is possible up to 24 hours before the start of the booked activity and the customer will be notified of the change by email or telephone.

ARTICLE 13 : Cancellation and modification of a reservation

Any request for cancellation, reimbursement or modification of a service reservation must be made by email to contact@vialitytour.com more than 24 hours before the start of the service. After this period, VIALITY TOUR reserves the right to refuse any request, whatever the reason.  

 

ARTICLE 14: Withdrawal period

According to Article L221-28 of the Consumer Code, the 14-day right of withdrawal cannot be exercised for contracts for leisure activities that are to be provided on a specific date or period.

ARTICLE 15: Evidence

It is expressly agreed that, except in the event of an obvious error by the seller, the data stored in the seller's information system shall have evidential value with regard to orders placed. Data on computer or electronic media kept by the seller constitute evidence and, if they are produced as evidence by the seller in any litigation or other proceedings, they shall be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same evidential value as any document that would be established, received or kept in writing. 

 

ARTICLE 16: Complaints and disputes

16.1. These special conditions of sale are subject to French law and are subject to the jurisdiction of the courts in Paris.

16.2. Any complaint arising during the execution of the services defined in these terms and conditions must be submitted as soon as possible by the client, on the spot and in an appropriate manner, so that VIALITY TOUR Paris can seek a solution as soon as possible.

16.3 For any complaint subsequent to or prior to the visit, the customer may make comments by sending an e-mail to the following address: contact@vialitytour.com

16.4 In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, VIALITY TOUR has set up a consumer mediation system. In the event of a complaint that has not been satisfactorily resolved within 45 days, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details can be obtained at: https: //www.mtv.travel

Article 17: Personal data

17.1 The personal data collected by VIALITY TOUR when purchasing a service is strictly reserved for the use of VIALITY TOUR.

17.2 In accordance with the French Data Protection Act of 6 January 1978, the user has the right to access, rectify and delete personal data concerning him/her at any time. If the user wishes to exercise this right, he/she can either write to the seller or make a request by e-mail to the seller. The data entered on the forms present on this site remain confidential to the seller.
