The General Terms and Conditions of Sale below apply to the sale of guided tour services by VIALITY TOUR.
VIALITY TOUR is a simplified joint stock company with its registered office at n°1 rue de Stockholm 75008 Paris, France, registered under SIRET number 901 771 881 00017.
The present terms and conditions apply to all purchases, use or reimbursement of services, as well as to all use of the https://www.vialitytour.com website .
ARTICLE 1: Definitions
The internet platform provides a description of the services offered by VIALITY TOUR.
VIALITY TOUR reserves the right to complete the present offer or to cease the distribution of certain services at its sole discretion and at any time.
PARTIES
Refers to the customer and/or the company VIALITY TOUR
CUSTOMER
Refers to the purchaser of an activity; the customer may or may not be the beneficiary of the service, depending on whether or not he/she makes personal use of it.
USER
Refers to the person connecting to the site, without necessarily being a customer or a beneficiary.
SERVICE
Refers to the service provided by VIALITY TOUR to the beneficiary, it being understood that the conditions of execution of this service are dependent on availability on the date chosen by the beneficiary.
PERSONAL DATA
Refers to any information used in particular on the Internet to identify a natural person (surname, first name, e-mail address)
COOKIES
Refers to small files sent to the hard disk of the user's computer in order to facilitate navigation on the site and to enable access to the most suitable pages when the user returns to the site
SITE
Refers to the site accessible under the URL https://www.vialitytour.com
ARTICLE 2: Scope of application
2.1 Acceptance of the general terms and conditions of sale is essential prior to purchasing, receiving or using an activity on the site.
The user acknowledges the general terms and conditions of sale in their entirety by clicking on the hypertext link provided for this purpose, and accepts them by ticking the appropriate box.
Failure to accept the general terms and conditions of sale in the aforementioned manner will deprive the user of the possibility of continuing with the booking process in progress.
In the event of opposition to the said general terms and conditions, the user will refrain from initiating the booking process.
2.2 The present general terms and conditions of sale apply only to activity bookings made on the site.
2.3 VIALITY TOUR reserves the right to modify these terms and conditions of sale at any time, without prior notice. In this case, the general sales conditions in force on the day of the order will apply.
2.4 All customers declare that they have the legal capacity, in accordance with article 1124 of the French Civil Code, to contract and use the website in accordance with the website's General Terms and Conditions of Sale and Marketing.
ARTICLE 3: Formation of the contract
3.1 Reservations can only be made by the user via the https://www.vialitytour.com website.
3.2 The user selects the activity offered from the online catalog.
3.3 The user selects the number of participants according to their age.
3.4 A summary is then sent to the user, showing the choices made and the total price of the booking, with an indication of the payment method chosen by the user.
3.5 In application of the provisions of article 1369-5 of the French Civil Code, this first click allows the user to check the details of his/her reservation, the total price of the reservation, and to rectify any errors before the final reservation is recorded.
3.6 The reservation is recorded and the contract is deemed definitively concluded only subject to acceptance of payment by the customer's bank.
3.7 In application of the provisions of article 1369-5 paragraph 2 of the French Civil Code, a confirmation email will be sent to the user, acknowledging receipt of the reservation sent to VIALITY TOUR.
3.8 Retention and/or printing of the confirmation email will enable the customer to provide proof that the reservation has been made with VIALITY TOUR.
ARTICLE 4: Terms of payment
4.1 The VIALITY TOUR website uses the Stripe secure payment system. It allows the customer to book his service immediately and firmly.
4.2 Payment can only be made by credit card, Visa card, Maestro card, Mastercard, American Express card or by PayPal.
4.3 Payment will result in the immediate debiting of the full amount of the reservation on the day the reservation is made.
4.4 In the event of non-payment or refusal of authorization by the customer's bank, VIALITY TOUR will be entitled to suspend the reservation process.
4.5 If the customer has a PayPal account and chooses to pay by credit card, the customer will have the option of paying via his/her PayPal account.
If the customer does not have a PayPal account, he/she will be asked to create one by following the instructions sent to him/her.
ARTICLE 5: Rates
5.1 The prices of visits appearing on the Site are expressed in euros and include all taxes.
5.2 VIALITY TOUR reserves the right to modify rates at any time and without justification. Services will be invoiced on the basis of the rates in force on the day of registration of the firm and definitive reservation.
5.2 VIALITY TOUR reserves the right to apply discounts and promotional offers at its own discretion. The offer will be clearly displayed on the Site and automatically taken into account at the time of payment of the reservation by the customer.
5.3 Once the booking has been validated and paid for, VIALITY TOUR cannot retroactively apply discounts and one-off promotional offers.
ARTICLE 6 : Validity of the offer
6.1 In the event of the purchase of a service that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail or telephone. The customer may then request a full refund or the rescheduling of the activity to an available date.
6.2 VIALITY TOUR reserves the right to cancel any tour that does not reach the minimum number of 2 participants. In this case, the booking fee paid for the cancelled tour will be refunded.
Article 7. Conditions of use of promotional codes
7.4 A promotional code may be used subject to availability.
ARTICLE 8: VIALITY TOUR's liability
8.1 VIALITY TOUR undertakes to make every effort to ensure the validity and clarity of the information provided to the user.
8.2 VIALITY TOUR undertakes to offer tours in accordance with the description given on the "Booking" page of the site.
ARTICLE 9: Customer liability
9.1 The customer agrees not to disrupt the tour.
9.2.1 The customer agrees to follow the guide's instructions regarding the use of the virtual reality headset throughout the visit.
9.2.2 VIALITY TOUR may claim compensation from the customer for any damage caused to the virtual reality headset by the customer during the tour, resulting from failure to comply with the instructions for use set out by the guide.
9.3 Any error concerning the activities ordered must be notified by the customer, by letter or e-mail (contact@vialitytour.com), within 48 hours of receipt of the reservation.
ARTICLE 10: Conditions for taking part in the visit
10.1 The general sales conditions must be brought to the attention of the beneficiary of the activity. The customer is responsible for providing this information.
10.2 The possibility of benefiting from a service is subject to prior presentation of the confirmation e-mail.
10.3 The tours offered on the Site are not accessible to children under the age of 8. The customer undertakes to respect this rule. VIALITY TOUR reserves the right to refuse any participant who does not respect the age limit.
10.4 As certain conditions must be taken into consideration (extreme weather conditions, physical condition of participants and physical condition of the guide), VIALITY TOUR may validly refuse to provide the service, or postpone it, if the required conditions are not met.
ARTICLE 11: Safety and Insurance
11.1 The customer is responsible for all damage caused by him/her during the service.
11.2 The customer is fully responsible for any incident that may occur during the activity (offence, accident, theft or loss of valuables, direct or indirect damage that the customer or participant may cause to other participants) and confirms that he/she has taken out civil liability insurance.
11.3 For its part, VIALITY TOUR has taken out professional liability insurance.
ARTICLE 12 : Other rights of the service provider
12.1 VIALITY TOUR may cancel the activity on the planned date without having to observe a cancellation deadline if weather conditions, administrative measures, strikes or other external circumstances which cannot be foreseen or which can only be avoided by the deployment of disproportionate efforts by VIALITY TOUR and which do not fall within its sphere of influence, in particular events of force majeure, make it impossible to carry out the activity or make it considerably more difficult or compromise it. In this case, the booking fee paid for the cancelled activity will be refunded.
12.2 VIALITY TOUR may refuse access to a tour to any participant who does not meet the conditions of participation required in these sales conditions. In this case, the reservation fee paid for the tour will not be refunded.
12.3 If a participant causes lasting disruption to the tour in any way, VIALITY reserves the right to exclude the participant from the tour. In this case, the booking fee paid for the tour will not be refunded.
12.4 VIALITY TOUR may make minor program changes at any time if this seems necessary due to circumstances arising at short notice. Minor program changes also include changing the meeting point for the tour if the customer can reach the new meeting point from the originally agreed meeting point on foot or by public transport within 15 minutes. A change of meeting point is possible up to 24 hours before the start of the booked activity, and the customer will be notified of the change by e-mail or telephone.
ARTICLE 13 : Cancellation and modification of a reservation
Any request for cancellation, refund or modification of a reservation must be made by email to contact@vialitytour.com more than 24 hours before the start of the service. After this deadline, VIALITY TOUR reserves the right to refuse any request, whatever the reason.
ARTICLE 14: Withdrawal period
According to Article L221-28 of the French Consumer Code, the 14-day right of withdrawal cannot be exercised for contracts for leisure activities that must be supplied on a specific date or during a specific period.
ARTICLE 15: Proof
It is expressly agreed that, in the absence of manifest error on the part of the seller, the data stored in the seller's information system has evidential value in respect of orders placed. Data stored on computer or electronic media by the seller shall constitute evidence and, if produced as evidence by the seller in any litigation or other proceedings, shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same evidential value as any document drawn up, received or stored in writing.
ARTICLE 16: Complaints and disputes
16.1. These special terms and conditions of sale are governed by French law and are subject to the jurisdiction of the courts of Paris.
16.2. Any complaint arising during the performance of the services defined herein must be lodged as soon as possible by the customer, on site and in an appropriate manner, so that VIALITY TOUR Paris can seek a solution as quickly as possible.
16.3 For any complaint subsequent to or prior to the visit, the customer may make comments by sending an e-mail to the following address: contact@vialitytour.com
16.4 In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, VIALITY TOUR has set up a consumer mediation system. In the event of a complaint which has not been satisfactorily resolved within 45 days, the customer may refer the matter to the Médiateur du Tourisme et du Voyage (Tourism and Travel Ombudsman), whose contact details can be obtained at: https: //www.mtv.travel
Article 17: Personal data
17.1 The personal data collected by VIALITY TOUR when purchasing a service is strictly reserved for the use of VIALITY TOUR.
17.2 In accordance with the French Data Protection Act of January 6, 1978, users have the right to access, rectify and delete their personal data at any time. If the user wishes to exercise this right, he/she simply needs to write to the seller, or to make a request by e-mail to the seller. The data entered on the forms present on the present site remain confidential to the seller.
